Out of Memory Error - Make - CommandButtonW

I was having a play with the common controls, and CommandButtonW for its foreground color. It runs fine it debug but when building the project it hits the Load cmdItem(Index) in either of the user controls, and displays an out of memory exception. It does not do this with a vanilla CommandButton

Here is an example project with some bits stripped (i get my data via .net)

So its not great that it only happens with CommandButtonW, but I also find it odd that it is running the code! I have read a bit about that and see that you can use Ambient.UserMode, but I get an error when trying to read that in the initialize. What is the correct way to use that in a user control?
